A Geneva winegrower has been found guilty of negligence after one of his workers lost an arm in an accident – despite the grower not being on the premises at the time.
The accident was in 2018. Two men were using a drilling machine to lay pipes. One of the men’s jackets was caught in the machinery and his arm was torn off.
Although the owner was not present at the time of the accident, the judge rules they still had a duty of care and should have noticed the machine was not supplied with a safety guard.
The winegrower received a suspended fine.
The injured worker welcomed the ruling and says he hopes the will raise awareness of the dangers of working in agriculture.
