One example is being highlighted – a customer bought a pair of ski goggles for CHF 58.90, but a few days after they were delivered, told there’d been an error and he has to pay a further CHF 208.
Press reports suggest it’s not an isolated case. The Swiss Consumer Forum says they know of a further 12 incidents.
In such a situation, the customer either has to pay or send back the item.
The consumer forum believes a court case is needed – as that would likely vindicate the buyer.
But one word of caution. Swiss law already acknowledges a clear and manifest error in pricing is not protected.
For example, a luxury watch listed at CHF 250 when it should be CHF 2,500 is an obvious error – and the potential buyer will not end up with a bargain.
