Mosquitos and the Federal Court

A case involving a small pond and mosquitos has made it all the way to the Federal Court.

Neighbours in an apartment building in canton Schwyz claim that a pond on a roof terrace is causing a mosquito problem. The pond was built in 2001.

A lawsuit demanded the pond be removed. The cantonal court rejected the case, saying the neighbours had not supplied enough evidence. It also said an independent report would not be able to determine the source of mosquitos. 

But federal judges have ordered the lower court to rethink. Saying it presupposes the outcome of an unwritten report.
