The Federal Court has backed the army’s decision to sack four members of the special forces as they refused to be vaccinated against covid.
The army argued the men needed to be vaccinated so they can be sent on mission abroad at short notice.
Judges agreed the sackings were proportional. While the court did agree the obligation to be vaccinated is an attack on personal freedoms – they argued professional soldiers are bound by a special legal relationship, especially due to the duty of obedience within the armed forces.
