2019 court case could impact companies currently working from home
A court case which started more than a year ago, could have an impact on companies which have sent many of their employees home due to the coronavirus pandemic.
The Federal Court ruled from April 2019 that employers should compensate workers for the use of their home if they are working.
A worker argued their employer forced them to work from home – and they wanted compensation.
The court agreed.
A figure of CHF 150 a month has been suggested.
But employment lawyers quoted by the press are suggesting the ruling can’t be used in the current situation as it’s temporary and exceptional.
But as firms may now be contemplating increased use of telecommuting even after the pandemic, it could become a factor – although firms may not have to pay compensation if the worker requests the ability to work from home.
